These Terms & Conditions (the “Terms”) are a binding agreement between you and Air Synergy (“Air Synergy,” “we,” “us,” or “our”) and govern your access to and use of our website at airsynergy.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, including Your Privacy Choices. If you do not agree, please do not use the Site.

These Terms govern your use of the Site only. The terms that apply to any heating, cooling, water-heating, or related services we perform for you (the “Services”) are set out in the written estimate or service agreement you sign, which controls in the event of any conflict with these Terms regarding the Services.

You must be at least 18 years old and able to form a binding contract to use the Site or request Services. By using the Site, you represent that you meet these requirements and that the information you provide is accurate and complete.

Air Synergy provides residential HVAC, water-heating, indoor-air-quality, and related home-comfort Services throughout the San Francisco Bay Area, including heating and cooling, heat pumps, ductless mini-splits, water heaters, and specialty systems. The Site describes our Services generally; specific scope, equipment, pricing, scheduling, and warranty terms are confirmed in your individual estimate or service agreement.

We are a California contractor licensed by the Contractors State License Board (CSLB), License No. 1054064. The license number also appears in the Site footer.

• Estimates are not binding until signed. Any estimate, quote, or price shown on the Site or provided verbally is an approximation based on the information available at the time and is subject to change once site conditions are verified. No price is final until set out in a written agreement signed by both parties.
• Promotions and offers are time-limited, may require minimum-purchase or eligibility criteria, cannot be combined unless expressly stated, and may be modified or withdrawn at any time before a signed agreement.
• Errors. We work to keep Site content accurate, but pricing, availability, specifications, and other details may contain errors or become outdated. We reserve the right to correct errors and to refuse or cancel an order or request affected by an error.

We may offer financing options through independent third-party lenders. Air Synergy is not a lender and does not make credit decisions. All financing is offered and administered by the lender, is subject to credit approval, and is governed by the lender’s own terms, rates, and disclosures. We are not responsible for a lender’s decisions, terms, or servicing.

Charges for completed Services are payable as set out in your service agreement or invoice. Late or unpaid balances may be subject to fees and remedies described in that agreement and permitted by law.

The information on the Site — including articles, guides, cost ranges, calculators, FAQs, and tools in our Learning Center — is provided for general educational purposes only. It is not professional engineering, installation, or safety advice for your specific home or system, and it is not a substitute for an on-site evaluation by a qualified technician.

Safety: If you smell gas or suspect a gas leak, leave the area immediately and contact your utility or 911. For any emergency, call 911. Do not rely on the Site for urgent or safety-critical decisions.

Some content on the Site may be created or assisted using artificial-intelligence or other automated tools and then reviewed for general accuracy. Such content is provided for general informational purposes only, may contain errors or omissions, and may not reflect your specific circumstances or the most current information. It is not advice you should rely on without confirmation from us. Any estimates, recommendations, or pricing that actually apply to you will be provided to you directly and confirmed in your written agreement.

Chat / AI assistants: This Site does not currently offer a live chatbot. If we add an AI assistant in the future, it will disclose that it is an “AI assistant” before you enter personal information, and any conversation may be retained to improve service quality subject to our Privacy Policy.

The Site and all content on it — including text, graphics, logos, images, photographs, video, layout, design, and software — are owned by Air Synergy or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual-property laws. The Air Synergy name and logo are our trademarks and may not be used without our prior written permission. All rights not expressly granted are reserved.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purpose of learning about and requesting our Services. You may not copy, reproduce, modify, distribute, sell, frame, scrape, data-mine, or create derivative works from the Site or its content without our prior written consent, except as expressly permitted by law.

When using the Site, you agree that you will not:

• Use the Site for any unlawful, fraudulent, or harmful purpose;
• Attempt to gain unauthorized access to the Site, our systems, or any account or data;
• Upload or transmit viruses, malware, or other harmful code, or otherwise interfere with the Site’s operation or security;
• Use any robot, spider, scraper, or automated means to access or collect data from the Site without our written permission;
• Submit information that is false, misleading, defamatory, infringing, or that violates the rights or privacy of others; or
• Use the Site to send unsolicited communications or to harass any person.

If you submit reviews, comments, suggestions, photos, or other materials to us or about us, you represent that you have the right to do so, and you grant Air Synergy a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in connection with our business (for example, sharing a testimonial), unless we agree otherwise in writing. We are not obligated to use any submission and may remove content at our discretion. Please don’t include confidential information in submissions you don’t want used.

The Site may link to or integrate third-party websites, content, and services — including financing partners, equipment manufacturers, review platforms, mapping, and chat tools. We do not control and are not responsible for third-party sites or services, their content, or their terms and privacy practices. Your use of them is at your own risk and governed by those third parties’ terms.

To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that the content is accurate, complete, or current.

This Section concerns your use of the Site only. It does not limit, waive, or replace any warranty we expressly provide for products or workmanship in your written service agreement, or any rights you have under the California Contractors State License Law or other non-waivable consumer-protection laws.

To the maximum extent permitted by law, Air Synergy and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Site will not exceed the greater of (a) the amount you paid us, if any, for access to the Site, or (b) one hundred U.S. dollars ($100). Liability for Services is addressed in your written service agreement.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify, defend, and hold harmless Air Synergy and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the arbitration agreement below, you agree that any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Contra Costa County, California, and you consent to their personal jurisdiction and venue.

Please read this Section carefully — it affects how disputes are resolved. Except as noted below, you and Air Synergy agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding arbitration, rather than in court, on an individual basis. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, and may take place in or near Contra Costa County, California, or be conducted remotely or by phone where the rules allow.

• Class-action waiver. You and Air Synergy agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
• Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in court for the actual or threatened infringement or misuse of intellectual property or unauthorized access to the Site. Nothing here waives any non-waivable right.
• 30-day opt-out. You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms to Air Synergy, 340 Cumberland St, Suite A, Pittsburg, CA 94565, or by email to info@airsynergy.com with the subject line “Arbitration Opt-Out,” and including your name and the email/phone you use with us. Opting out will not affect any other part of these Terms.

Arbitration under these Terms is administered under the AAA Consumer Arbitration Rules unless we mutually agree in writing to a different administrator.

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or to protect the Site, our business, or others. Provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and arbitration — will survive termination.

We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Changes are effective when posted, and your continued use of the Site after that means you accept the revised Terms. Please review this page periodically.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and severed from the remaining provisions, which will continue in full force and effect.

These Terms, together with our Privacy Policy (including Your Privacy Choices) and any written estimate or service agreement you sign with us, constitute the entire agreement between you and Air Synergy regarding the Site and supersede any prior agreements on that subject. Our failure to enforce any provision is not a waiver of it.
